Terms and Conditions
This Contract of Hire shall be between you
(subsequently referred to as 'Holidaymaker') and us
(subsequently referred to as 'Property Owners').
1. Booking:
a) On receipt of your email enquiry, the holiday property
will be provisionally booked. This will be held for a
period of seven days only.
b) If no Booking Form and deposit (in the form of a cheque
made payable to 'Salruth Cottage') is received within this
period, then the provisional booking will be cancelled.
c) At least one person in the Holidaymaker's party must be 21
years of age or over.
d) The Property Owners reserve the right to decline a
provisional booking after receipt of the Booking Form, in
which case the Holidaymaker's deposit will be fully refunded.
The Property Owners are under no obligation to provide
details as to why the booking request was declined.
2. Confirmation: Immediately on receipt of the holiday
confirmation from the Property Owners, the Holidaymaker
should check the details and notify the Property Owners
immediately of any correction as soon as possible.
3. Payment:
a) bookings made within 6 weeks of the holiday date must be
paid for in full and in advance of occupation of the holiday
property.
b) for bookings made more than 6 weeks before the holiday
date, a deposit of 50% of the total rental charge must be
submitted along with the Booking Form.
c) on payment of the deposit and subject to acceptance of
the booking, the Holidaymaker becomes liable for payment of
the balance of the rental charge 6 weeks before commencement
of the holiday. 4. Availability: The Contract of Hire is made on the
understanding that the holiday property and its facilities as
published on the website will be available for the dates
stated. In the unlikely event that the holiday property is
not available through events arising outwith the control of
the Property Owners, then the booking may be cancelled. The
Holidaymaker will be advised of any such circumstances as
early as possible, and will be refunded all monies paid in
full. The Holidaymaker shall have no further claim against
the Property Owner.
5. Holidaymaker's Responsibilities: During the period
of the holiday, the Holidaymaker undertakes the
following:
(a) that the number of people occupying the property will
not exceed five (plus an optional cot). If it does the
Property Owners or their representative can refuse to allow
the Holidaymaker to take possession of the property or make
the Holidaymaker leave the holiday property before the end of
the holiday. If this happens, the Property Owners shall treat
the holiday as being cancelled by the Holidaymaker and the
Holidaymaker shall have no claim against the Property Owners
for compensation or reimbursement whatsoever.
(b) that the property will be used solely for the purpose of
a holiday by the Holidaymaker and his party.
(c) to show due consideration for other parties. If the
Holidaymaker abuses the property or displays dangerous,
offensive or rude behaviour to the Property Owners, their
representative or any third parties (e.g. neighbours), the
Property Owners have the right to ask the Holidaymaker to
leave the property before the end of the holiday. If this
happens, the Property Owners shall treat the holiday as being
cancelled by the Holidaymaker and the Holidaymaker shall have
no claim against the Property Owners for compensation or
reimbursement whatsoever.
(d) to allow the Property Owners or their representative
access to the property at any reasonable time during the
period of the holiday.
(e) to keep the property and all furniture, utensils,
equipment, fixtures and fittings in or on the property in the
same state of repair and condition as at the commencement of
the holiday and to ensure that at the end of the holiday the
property is left in the same state of order and cleanliness
in which it was found. The Property Owners reserve the right
to levy an additional charge for any extra cleaning required
after the Holidaymaker’s occupancy.
(f) to report as soon as possible to the Property Owners any
breakages or damage caused by the Holidaymaker during the
holiday and to reimburse the Property Owners with the cost of
replacement. The Property Owners reserve the right to make a
claim against the Holidaymaker for repair or loss as a result
of damage caused.
(g) to notify all other members of the Holidaymaker’s party
of these conditions.
(h) to arrive after 3 p.m. on the arrival day and to vacate
the property by 10 a.m. on the day of departure unless prior
arrangement has been agreed with the Property Owners.
6. Pets: Pets
are not allowed inside the property.
7. Linen: The property is equipped with bed linen and
towels for the number of people listed on the Booking Form.
Linen and blankets for cots are not supplied and should be
brought by the Holidaymaker.
8. Liability: The Property Owners cannot accept
liability for any damage, expense, injury, death or loss of
any nature whatsoever suffered by any person(s) in the
Holidaymaker's party from any cause
whatsoever.
9. Smoking: Smoking
is not allowed inside the property.
10. Special Needs: It
is the Holidaymaker's responsible to advise the Property Owners
at the time of booking of any special requests or needs. The Property Owners, however, cannot
guarantee that any requests will be met. Failure to meet
special requests will not be a breach of contract. It is the
Holidaymaker's responsibility to satisfy themselves that the
property is completely suitable for their needs. Please note
that if a particular requirement is not specified on the
website then it is not provided.
11. Motor Car and Personal Belongings: Baggage and
personal belongings are at the Holidaymaker's risk at all
times, and the Property Owners accept no responsibility for
loss of or damage to any vehicle or its contents.
12. Cancellation:
(a) The Holidaymaker should notify the Property Owners
immediately and in writing of any intention to cancel the
holiday booking. The cancellation only takes effect when the
Property Owners have received written confirmation from the
Holidaymaker.
(b) If the Property Owners are unable to re-let the holiday
property for the period of the cancelled holiday, all monies
paid by the Holidaymaker to the Property Owners shall be
forfeited to the Property Owners.
(c) If the holiday property is re-let, monies received by the
Property Owners for the relet holiday, less a handling charge
of £50, will be refunded to the Holidaymaker.
(d) Holiday cancellation insurance is not provided by the
Property Owners and is not included in the price of the
holiday. All Holidaymakers are recommended to take
independent advice on appropriate holiday insurance.
13. Complaints: Every effort has been made to ensure
that the Holidaymaker has an enjoyable holiday. If
however, the Holidaymaker has any cause for complaint they
must contact the Property Owners immediately so that it can
be speedily resolved. The Property Owners cannot subsequently
consider any complaints or enter into any correspondence
about complaints unless this procedure has been followed.
14. Data protection and Privacy: Information provided
on Booking Forms will remain confidential and will not be
disclosed to a third party or used for any other purpose.
